BOOKINGS

The signing of the booking form by the party leader confirms acceptance of the terms and conditions set out and shall be binding on the persons listed on the booking form intending to occupy the premises (or any subsequent amendments to this list)

No all male or female parties or parties where all guest are under the age of 21 will be accepted. Our villa is a NON SMOKING villa, however you may smoke on the patio area using the ashtrays provided. NO PETS are allowed.

Our villa is registered with the state authorities and is in compliance with all relevant legislation to ensure your comfort, security and peace of mind.

RENTAL PERIOD

The rental period generally consists of a Saturday to Saturday booking, however other periods are occasionally available (please ask for details). Midweek bookings may incur a 10% surcharge. Stays of 7 nights or less will incur a cleaning fee of £45 ($85). The villa is available from 4.00 pm US local time on the day of arrival and is to be vacated by 10.00 am on the morning of departure. Vacating after 10.00am may incur a charge equivalent to one day's accommodation cost unless previously agreed with the owner. If you wish you can arrange to arrive earlier or leave later if the villa is not occupied but only with prior arrangement with us or our villa manager.

PAYMENT

Together with your completed booking form, a non-refundable deposit of £100 ($190) per week is due within 7 days of you provisional booking. Upon receipt of your deposit we will send you confirmation of your booking. Payment of the balance is due 10 weeks prior to your arrival date.We will send you directions to the villa and details relating to access to the villa near to your holiday.

SECURITY DEPOSIT

You are solely responsible for any damage or breakages that may be caused to the property or its contents by any members or your party (or any visitors/guests you invite to the villa) during your stay. We require a refundable security breakage/damage deposit of £300 ($570) to be paid via Visa payment at the time of your arrival direct to the Villa Manager. This deposit will be re-credited to the same Visa card with a few days of your departure, i.e. once our Villa Manager has checked that all is in order at the villa and that there are no breakages, damage or missing items. Our Villa Manager will check our villa before your arrival and after your departure and will advise us of any problems. This may include additional cleaning costs for removal of stains etc., arising from spillage and the like. We reserve the right to retain the security deposit

(either in full or part) to cover damage, missing inventory items or non-return of keys. Receipts will be provided for repairs/replacements in the unlikely event that retention of the security deposit is necessary. We reserve the right to pursue you for recompense where the cost of any damage, repairs or replacement of missing items caused by you or any of your party (or visitors invited into the villa by you during your stay) exceeds the value of the security deposit. We will require you to make payment of such recompense within 14 days of being served notice of this.

Florida has a sub-tropical climate and care must be taken with food that is left uncovered and with garbage disposal. Uncovered food attracts insects very quickly. Any additional pest control measures costs that are incurred as a result of lack of care or non-observance of the garbage collections requirements by you will be deducted from your security deposit.

CLEANING

The villa is cleaned by our management company before your arrival and after your departure, we would request that guests leave the villa in a clean and tidy condtion. 

CANCELLATION BY GUESTS

- cancellation in the period from booking up until 10 weeks before the vacation/holiday is due to begin, i.e. when the full balance is payable, will result in loss of the whole of the booking deposit.

- Failure to pay the final balance by the due date 10 weeks prior to arrival will result in the loss of deposit, we will endeavour to contact you but if we receive no communication unfortunately we reserve the right to cancel the booking and retain the deposit. If you have a problem PLEASE contact us.

- Cancellation between 6 and 10 weeks of commencement of the vacation/holiday will incur a cancellation charge of 50% of the total cost of the booking.

- Cancellation less than 6 weeks before the vacation/holiday is due to commence will incur a cancellation charge of 100% of the total cost of the booking.

We strongly advise that all guests take out holiday, injury, medical and cancellation insurance at the time of booking.

CANCELLATION BY OWNERS

In the unlikely event that personal circumstance necessitate cancellation of the booking we will refund any monies paid by the party (without interest, compensation of consequential loss of any kind). However, our Villa Manager will always seek to relocate your booking to a villa of similar or superior standard on the same community (development).

FORCE MAJEURE

The owners nor our Villa Manager, accept any responsibility or liability whatsoever for any loss or damage or alterations to the terms of this booking, caused by events beyond our control including but not restricted to war, civil commotion, flight delays or cancellations, technical difficulties with transportation, alteration or cancellation of

schedules by carriers, adverse weather conditions, fire, flood, industrial dispute or any other event beyond our control.

SAFETY AND SECURITY

To comply with State Fire Regulations, under no circumstances must any more than the maximum number of persons identified on the booking form occupy the villa.

SWIMMING POOL 

The swimming pool is used entirely at your own risk. NO DIVING is allowed and children MUST be supervised at ALL TIMES whilst in the pool and spa areas. Glasses and crockery are not allowed on the pool and spa area at any time. Please use the plastic items provided. Pool security fencing is available to be put into place for parties where young children make up part of the group. It is the responsibility of the adults in the party to ensure this safety feature is utilised. We accept no liability whatsoever for any pool or poolside accidents.

The rental price excludes pool and spa heating.  In the event that pool heating is requested we cannot guarantee the actual temperature of the water in the pool. Our management company try for a temperature of 85F (higher temperatures may incur an additional cost).  This is dependent on many facors beyond our control,including the ambient temperature and general weather conditions.

For your safety and  comfort the pool and spa is inspected, cleaned if necessary and occasionally it may be necessary to apply chemicals and salt to the pool and spa.  Should this occur during your stay it may be necessary to avoid using the pool and spa for a short period - this is a normal part of pool maintenance.

Guests are not permitted to touch the pool heater controls (these are set by our management company) any problems arising from tampering with these controls will be deducted from the security deposit.

During cooler months it is the repsonsibility of renters to use the pool cover to retain heat. 

COMPLAINTS

In the unlikely event of a problem arising with the villa during your stay, you must immediately contact our Villa Manager who will seek to resolve the matter at the earliest opportunity. Your satisfaction with our villa is of paramount importance to us and should you consider that the matter is of a serious nature, we ask you to contact us directly with 14 days of your departure from our villa. However, if the problem has not been reported to our Villa Manager, we cannot accept any responsibility for any issues that may have arisen.

DISCLAIMER

LIABILITY The villa is privately owned and neither us nor our Villa Manager accept any liability whatsoever for personal injury, accidents loss or damage to persons or personal effect however caused.

We and our Villa Manager reserve the Right of Entry to our villa at any time. This includes workers such as pool maintenance gardeners etc.

VILLA DESCRIPTION

Whilst all information supplied in the brochure and on web sites is deemed to be correct to the best of our knowledge, it is understood that the information is supplied in good faith but is for guidance purposes only and does not form any part of the contract entered into as a result of placing a booking.

LAW

This contract is subject to and shall be constructed with the laws of England and the parties hereby submit to the exclusive jurisdiction of the English Courts.
